Can I Sell Digital Downloads Made From Licensed Clipart? What Creative Fabrica's Licenses Say
Direct answer: It depends on the license you hold, and marketplaces word it differently. This guide reads one marketplace's current text, Creative Fabrica's, so you can see what a real license says. Creative Fabrica's Subscription License and its Single Sales License each have a "Digital End Products" section. Both say you may not "Create a digital product that includes single elements or allows users to extract the elements that you've used." Other marketplaces and other tiers can say something different. This is not legal advice.
TL;DR: Creative Fabrica defines a Digital End Product as "a product in a digital format that is intended for sale to multiple people." Its Digital End Products section allows using elements to make "a new design," and asks that combined designs be "flattened." It says you "cannot bundle multiple designs and sell that as a new product." Read the license attached to your own download, since terms and tiers differ and can change.
What Creative Fabrica says a Digital End Product is
In both licenses the Digital End Products section opens: "A Digital End Product is a product in a digital format that is intended for sale to multiple people (for example a wedding invite template). Creating a logo or a website for 1 client is not considered an end product and is fully covered under this license."
The two licenses, "Subscription License" and "Single Sales License," use the same wording in this section on the date this guide was checked. They are separate pages, so if you hold one of them, check that page.
What the section allows
Under "You are allowed to," each license lists: "Use elements to create a new design. For example, you are allowed to use floral elements to create a floral themed wedding template." And: "Create new designs combining multiple downloaded resources and adding items of your own, as long as the new design is flattened and the original items cannot be extracted."
The full license text of each page adds a condition that applies on top of those lists. It says: "You are allowed to create digital end products that you sell. In all cases, the product that you create must have distinctive new features that will create an entirely new product that won't compete with the original product. Combining multiple downloads into 1 product is not enough." Its example: "If you download a flower and create a card with just that flower without making significant modifications to the original product, this is prohibited." So flattening a file or combining downloads is not the whole test in these licenses.
What the section does not allow
Under "You are not allowed to," each license lists:
- "Create end products that compete with the original product. For example, you cannot bundle multiple designs and sell that as a new product, or simply change basic elements such as color and size and sell that as a new product."
- "You cannot sell in a way that is directly competitive with the original item that you downloaded."
- "Create a digital product that includes single elements or allows users to extract the elements that you've used (all designs must be flattened)."
Each license's general "You are not allowed to" list also says: "Resell, sub-license, share or (re)distribute any of the digital files."
What this does not tell you
- It is Creative Fabrica's wording for its two licenses. It does not describe other marketplaces, other Creative Fabrica license types, or a bundle bought from an Etsy seller, which may come with its own license text.
- It does not say your particular download is a "Digital End Product" use, or that any specific product is allowed or not. Whether a specific product qualifies is a question about your license and your product.
- Creative Fabrica's page says the license is "effective on all sales and downloads" made on and after a stated date. Older downloads may fall under older terms.
If you are unsure, read the license that came with the download and consider asking the marketplace or a lawyer.
